1. About Valour Automotive

This website is operated by Valour Performance LTD, trading as Valour Automotive.

By using this website, making an enquiry, reserving a vehicle, selling a vehicle to us, part exchanging a vehicle, or purchasing a vehicle from us, you agree to these Terms & Conditions.

2. Vehicle Information

We make every effort to ensure that vehicle descriptions, mileage, specification, images, pricing and availability are accurate at the time of publication.

However, vehicle information is provided in good faith and may occasionally contain errors or omissions. Buyers should satisfy themselves that the vehicle specification, condition, mileage, history and features meet their requirements before purchase.

Images may be for illustrative or marketing purposes and may not show every mark, defect or feature of the vehicle.

3. Vehicle Availability

All vehicles are subject to availability and may be withdrawn from sale at any time without notice.

An enquiry, viewing appointment or finance application does not reserve a vehicle unless a reservation payment has been accepted by Valour Automotive.

4. Pricing

All vehicle prices are listed in pounds sterling.

Unless otherwise stated, prices include VAT where applicable. Prices may change without notice. We reserve the right to correct pricing errors before completing a sale.

Additional costs may apply for delivery, extended warranty, finance products, administration, or optional extras where agreed with the customer.

5. Reservations and Deposits

A vehicle may be reserved once a reservation payment or deposit has been accepted by Valour Automotive.

Reservation terms, including whether the payment is refundable or non-refundable, will be confirmed at the point of reservation.

If a customer cancels after agreeing to purchase a vehicle, Valour Automotive may retain reasonable costs incurred, including but not limited to preparation, transport, administration, advertising withdrawal or finance processing costs, where legally permitted.

6. Vehicle Preparation

Valour Automotive aims to prepare vehicles to a high retail standard before handover.

Where required, vehicles may be serviced, MOT’d, valeted or subject to preparation work before sale. Any agreed preparation work should be confirmed in writing before completion of the sale.

Used vehicles are not new vehicles and may show signs of age, mileage and normal wear.

7. Warranty

Unless otherwise stated, vehicles supplied by Valour Automotive include a 3-month warranty.

Warranty cover is provided subject to the warranty provider’s terms, conditions, claim limits, exclusions and repair process.

The warranty does not replace or reduce your statutory rights. Under the Consumer Rights Act 2015, vehicles sold by traders to consumers must be of satisfactory quality, fit for purpose and as described.

Extended warranty options may be available at additional cost.

8. Consumer Rights

Nothing in these Terms & Conditions affects your statutory rights.

When purchasing a used vehicle from a trader, consumers have rights under the Consumer Rights Act 2015. This includes the requirement that the vehicle must be of satisfactory quality, fit for purpose and as described.

If a qualifying fault is present at the time of sale, consumers may have a short-term right to reject within the first 30 days. After 30 days, the seller may usually have one opportunity to repair or replace the vehicle before further remedies apply.

Any claim will be assessed based on the age, mileage, price, condition and description of the vehicle at the time of sale.

9. Distance Sales

Where a vehicle is purchased entirely at distance, without the customer visiting our premises or inspecting the vehicle in person before purchase, additional cancellation rights may apply under the Consumer Contracts Regulations.

These rights may not apply where the transaction is completed in person, where the customer has viewed or inspected the vehicle before purchase, or where the purchase is not classed as a distance sale.

Customers should ask us before purchase if they are unsure whether distance selling rights apply. Distance-sale car purchases can carry a 14-day cancellation right where the full transaction is completed remotely.

10. Payment

Vehicles must be paid for in full before collection or delivery unless finance has been agreed and paid out by the finance provider.

Accepted payment methods include bank transfer, finance settlement, or other methods agreed by Valour Automotive.

We reserve the right to withhold release of a vehicle until cleared funds have been received.

11. Finance

Finance may be available subject to status, lender approval, affordability checks and terms.

Valour Automotive may introduce customers to finance providers or brokers. Finance agreements are between the customer and the finance provider.

Customers should read all finance documents carefully before signing.

12. Part Exchange

Part exchange valuations are provided based on the information supplied by the customer, including mileage, condition, service history, MOT status, ownership history and finance position.

Any part exchange offer is subject to physical inspection. We reserve the right to amend or withdraw a valuation if the vehicle differs from the description provided, has undisclosed damage, mechanical faults, outstanding finance, mileage discrepancies, missing documents, missing keys or adverse history.

The customer confirms that they have the legal right to sell or part exchange the vehicle.

13. Selling Your Car to Valour Automotive

Valour Automotive may offer to purchase vehicles from private sellers.

Any online, telephone or email valuation is provisional and subject to inspection, history checks, finance checks and confirmation of ownership.

Where a customer provides a genuine written quote from another car-buying service, we may aim to match or beat that quote where possible. We are not obliged to match or beat any quote if the vehicle does not meet our stock requirements, the quote is not genuine, the vehicle condition differs, or the offer is commercially unsuitable.

Once a purchase price has been agreed and ownership checks are complete, payment will be made by bank transfer.

14. Test Drives

Test drives are at the discretion of Valour Automotive.

Customers may be required to provide a valid driving licence, proof of address and insurance confirmation before a test drive. We reserve the right to refuse a test drive for any reason.

The customer may be liable for any damage, fines, penalties or losses caused during a test drive.

15. Collection and Delivery

Vehicles may be collected from an agreed location or delivered where arranged.

Delivery times are estimates only and may be affected by preparation, transport availability, finance payout, payment clearance, weather or other circumstances outside our control.

Risk in the vehicle passes to the customer on collection or delivery.

16. Vehicle Handover

At handover, the customer should inspect the vehicle and confirm that they are satisfied with its condition, agreed preparation, documents and accessories.

Any concerns should be raised before accepting the vehicle where reasonably possible.

17. Vehicle Tax, Insurance and Legal Use

It is the customer’s responsibility to ensure that the vehicle is taxed, insured and legally permitted to be used on the road after purchase.

Unless otherwise stated, vehicle tax is not included in the purchase price.

18. Customer Responsibilities

Customers must provide accurate information when buying, selling or part exchanging a vehicle.

This includes but is not limited to identity, address, finance status, mileage, ownership, service history, vehicle condition and any known faults.

Valour Automotive may cancel a transaction if false, misleading or incomplete information is provided.

19. Website Use

You may use this website for lawful purposes only.

You must not attempt to interfere with the website, copy content without permission, submit false information or use the website in a way that may damage Valour Automotive or other users.

All website content, including text, images, branding, logos and design, belongs to Valour Automotive or its licensors unless otherwise stated.

20. Limitation of Liability

Valour Automotive does not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or breach of statutory rights.

Subject to the above, we are not liable for indirect losses, loss of profit, loss of opportunity, loss of business, or losses caused by incorrect information supplied by the customer.

22. Changes to These Terms

Valour Automotive may update these Terms & Conditions from time to time.

The version published on this website at the time of use or transaction will apply unless otherwise agreed in writing.

23. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the courts of England and Wales.
